The dispute is relevant to patients who use cannabis outside work, but the complaint remains unproven and the timing and scope of California protections require careful treatment.

A positive cannabis test and current impairment are not interchangeable findings. Some tests can detect prior exposure after noticeable effects have ended, while workplace rules vary by job, test method, federal obligations, safety duties, and state law. Clinicians can support accurate documentation of the treatment target, route, dose, timing, functional effects, and adverse effects without promising a legal accommodation. A Tesla worker alleges that a positive THC test led the company to deny a transfer to less physically demanding work. The lawsuit raises important questions about off-duty medical cannabis use, impairment testing, disability accommodation, and the limits of California employment protections.

What This Study Teaches Us
The complaint alleges disability discrimination, retaliation, and harassment after the worker sought a transfer and tested positive for THC. It does not establish that Tesla violated the law, and Tesla had not responded to SFGATE’s request for comment when the story was published.
Why This Matters
Patients may use cannabis outside work for symptom management yet still face employment consequences. The practical question is not simply whether cannabis is legal, but which law applies, what the test measured, when the events occurred, and whether the position falls within an exception.
